What is a NIF?
The NIF is the Spanish Tax Identification number. Its obtaining is mandatory for all legal entities that will be shareholders or directors of companies resident in Spain, owners of branches in Spain, or other types of legal entities established or that have employees in Spain.
Is it a long process?
The procedure for this modality is pretty much simple and can be done before the Spanish Authorities really fast. For this purpose we will need different documents from the company and its representative. The procedure, since we receive the document can last between 3 - 6 weeks approximately.
Which are the benefits of this alternative before others?
The use of the figure of the foreign entity with NIF gives the opportunity to companies that want to expand internationally to have more time to assess whether such expansion is necessary and what is the best way to carry it out. This legal alternative to the EOR, in addition, allows the company to have a worker hired directly with their non-resident NIF without assuming more obligations than those derived from said hiring before the Tax and Social Security Agency.
Are there any tax or Labour obligations with this alternative?
Yes, tax and Labour obligations are generated with this modality, but these are much less than if a Company was established in Spain only for the purpose of employing a Spanish resident. We will take care that all the obligations are complied with.
Is it necessary to have a representative in Spain? If so, can the Spanish resident employee be appointed as representative?
Yes, it is necessary to have a representative of the foreign Company in Spain, with Spanish residence and, for this purpose, the Spanish employee (as a Spanish resident) can be appointed as such.
